How divorce works in England and Wales

Divorce ends a marriage. It does not, by itself, settle finances or decide where children live. Keep three tracks on separate lines: the divorce application, financial arrangements, and arrangements for children. One track may move while another is still unresolved.

The process map

1. One spouse applies alone or both apply jointly, stating that the marriage has irretrievably broken down.
2. The court issues the application and the respondent is notified in a sole application.
3. After the statutory waiting period, the applicant can seek a conditional order. This is the court’s confirmation that the divorce may proceed, not the end of the marriage.
4. After a further minimum period, the applicant can seek a final order. This ends the marriage.

The normal minimum is 20 weeks from issue before applying for the conditional order, then at least 43 days after it is made before applying for the final order. Processing and response time can lengthen the journey. Finances may need separate attention before finalising: obtain individual advice if timing affects pensions, inheritance or other rights.

Exercise: three-track board

Draw three columns headed Divorce, Money and Children. Under each, put a question you can answer now, a document to find, and a decision you must not assume the divorce order will make. For example, a final order belongs to the first column; pension information belongs to the second.
